Campos explicou que a ArcelorMittal enfrenta situação antagônica na logística de entrada de matérias-primas e de saída de produtos acabados. O modal hidroviário responde por 95% do transporte das bobinas brutas de aço a serem beneficiadas na fábrica de São Francisco do Sul, restando ao rodoviário os outros 5%. É a situação diametralmente oposta à da saída dos produtos fabricados – 95% pelo meio rodoviário e 5% pelo hidroviário.

A redação da Câmara é um substitutivo do relator pela Comissão de Desenvolvimento Econômico, Indústria e Comércio, deputado Danilo Forte (União-CE).
Segundo o texto aprovado, a desconsideração da personalidade jurídica poderá ser usada quando ficar caracterizada a ocorrência de manobras ilícitas, por parte dos proprietários das empresas, para não pagar os credores, situação na qual seus bens particulares serão usados para pagar os débitos. Hoje, apesar de a possibilidade ser prevista em lei, não há um trâmite específico para ela. O projeto institui um rito procedimental, assegurando o prévio direito ao contraditório em hipóteses de responsabilidade pessoal do sócio por dívida da empresa.
O prazo para os sócios apresentarem defesa é de 15 dias, contados da intimação. Em requerimento específico, deverão ser especificados os atos que motivaram a responsabilização do sócio. Essa indicação deverá ser feita por quem propuser a desconsideração da personalidade jurídica ou pelo Ministério Público. Além disso, o juiz não poderá decidir a questão antes de assegurar o direito amplo de defesa. Os sócios ou administradores terão ainda o direito de produzir provas, e o juiz somente poderá decretar a desconsideração depois de ouvir o Ministério Público. Caso a medida seja decretada, ela não poderá atingir os bens particulares dos membros, instituidores, sócios ou administradores que não tenham praticado ato abusivo em prejuízo dos credores da pessoa jurídica e em proveito próprio.

A projeção das receitas com tributos administrados pela Receita Federal caiu R$ 3,5 bilhões, refletindo a desaceleração da economia no segundo semestre. No entanto, a estimativa para as receitas não administradas subiu R$ 10 bilhões em relação a setembro, decorrentes principalmente da alta no preço internacional do petróleo (+R$ 3,4 bilhões) e do pagamento de dividendos recordes pela Petrobras (+6,2 bilhões).

O governo do Paraná encaminhou para a Assembleia Legislativa um projeto de lei que cria o Fundo de Desenvolvimento da Infraestrutura Logística do Estado (FDI/PR) cuja arrecadação virá da taxação de produtos agropecuários. A proposta prevê a tributação das operações de comercialização de milho, soja, trigo, suínos, frangos, entre outros produtos. Proposta semelhante foi aprovada em primeiro turno em Goiás na semana passada e deverá ser votada novamente nesta terça-feira (22).
Segundo o governo paranaense, o projeto é destinado a financiar “o planejamento, estudos, execução, acompanhamento e avaliação de obras e serviços de infraestrutura logística em todo o território paranaense” para obter “maior competitividade aos estabelecimentos produtores, indispensável diante o avanço da integração dos mercados e, consequentemente, do acirramento concorrencial”.
O texto condiciona a manutenção do diferimento aplicado ao ICMS cobrado do agronegócio atualmente à adesão dos produtores à nova contribuição ao fundo. Pela proposta, cada produto terá uma taxa específica, baseada na Unidade Padrão Fiscal do Paraná (UFP/PR), hoje em R$ 127,06. De acordo com esse indicador, as cobranças devem variar entre R$ 0,90 e R$ 41,49 por tonelada dos produtos agrícolas e de R$ 0,11 a R$ 53,59 por animal no caso da pecuária.
Em seu site, a Federação da Agricultura do Estado do Paraná (Faep) se posiciona contra. “A realidade no campo exige respeito e cautela, não pensando em mais custos e sim procurando estímulos para a produção e apoio aos produtores rurais. Em nenhum momento o setor foi ouvido, gerando ainda mais surpresas. Estudo preliminar aponta que o custo total ficaria entre R$ 1 bilhão e R$ 2 bilhões. Pedimos que, nesse momento, os produtores rurais procurem os deputados estaduais e reforcem o pedido para que tal projeto de lei não seja aprovado”, intercede Ágide Meneguette, presidente da Faep.

Pesquisa da CNI aponta que o nível da atividade e o número de empregados desaceleraram depois de quatro meses de altas
A Sondagem Indústria da Construção, da Confederação Nacional da Indústria (CNI), mostra desaceleração em dois indicadores importantes para o setor: atividade e emprego. O índice de evolução do nível de atividade da indústria da construção passou de 53,4 pontos para 50 pontos em outubro de 2022. Esse indicador varia de 0 a 100, e dados acima de 50 pontos indicam crescimento, abaixo desse valor, queda. Como ficou exatamente na linha divisória, a atividade mostrou-se estável entre setembro e outubro.
O índice de evolução do nível de número de empregados da construção recuou de 53,4 pontos para 50,6 pontos em outubro de 2022. Mesmo com a queda no ritmo de alta, o emprego subiu na construção. Assim, outubro registrou a quinta alta consecutiva nas contratações. “A estabilidade na atividade da construção ocorreu após sequência de quatro meses de altas significativas e o emprego cresceu muito pouco, mas cresceu. Ainda temos dados elevados apesar da desaceleração. Mas as expectativas indicam que, nos próximos meses, seguiremos com um ritmo menor de expansão, até mesmo com uma possível queda da atividade e do emprego em algum mês”, avalia o gerente de análise econômica da CNI, Marcelo Azevedo.
A utilização da capacidade operacional da construção não variou, permanecendo em 68% pelo quarto mês consecutivo. É o mais elevado nível de utilização da capacidade operacional na construção para um mês de outubro desde 2013. Em novembro de 2022, o Índice de Confiança do Empresário (ICEI) da indústria da construção caiu 6,2 pontos, para 53,9 pontos. O principal fator que explica o recuo foi a expectativa para a economia brasileira para os próximos seis meses, que indica migração de um estado de otimismo para um estado de pessimismo dos empresários da construção.
